1. About the platform

CroaHoliday (hereinafter: "Platform") is an online platform for advertising and direct rental of accommodation facilities in the Republic of Croatia, available at croaholiday.com. The Platform allows accommodation owners (hosts) to advertise their properties and communicate directly with potential guests, without intermediaries and without a commission on reservations. CroaHoliday is not a party to the contractual relationship between the host and the guest. The platform merely provides the technical framework for establishing contact and exchanging information.

2. Platform Users

By registering on the Platform, the user confirms that they are a fully capable natural person or a legal entity authorized to enter into a contract. The user agrees to use the Platform in accordance with these Terms, the applicable laws of the Republic of Croatia and the European Union, and the principles of good faith and fair business practices. It is prohibited to open multiple accounts, use false identities, or otherwise misuse the Platform.

3. Host's Obligations

The Host is obligated to: (a) have all necessary approvals to provide accommodation services in accordance with the Law on Hospitality Activities and relevant regulations; (b) publish the accurate and up-to-date license / registration number of the accommodation facility; (c) ensure that the accommodation details (description, photos, prices, capacity) are accurate and up-to-date; (d) respond to guest inquiries in a timely manner; (e) honor the agreed-upon terms with guests. CroaHoliday reserves the right to remove listings that do not comply with applicable regulations or that damage the reputation of the Platform.

4. Reservations and Payment

CroaHoliday does not charge a commission on bookings. The host only pays for the chosen advertising plan (Pro, Premium or Elite), by card or bank transfer, through the secure Stripe payment system. The payment and subscription terms are described in section 5. All financial transactions between host and guest take place directly, without the Platform's involvement. CroaHoliday is not responsible for the non-fulfilment of financial obligations by either party.

5. Subscription, Cancellation, and Right of Withdrawal

CroaHoliday offers the free Basic plan and the annual advertising plans Pro, Premium and Elite. Plan prices and limits (number of properties and units, features) are listed on the Plans page and are shown before the purchase is confirmed. A paid plan is valid for one year from payment. Payment: Plans are paid by card or by bank transfer, through the Stripe payment system. CroaHoliday never sees or stores card numbers; card data is processed only by Stripe. – Card: the plan is activated as soon as the payment succeeds. – Bank transfer: after ordering you receive the payment details by e-mail (an IBAN that is valid only for your account, the amount and a 14-day deadline). The plan is activated automatically when the payment arrives, usually within 1–2 working days. Until then, your current plan stays as it is. Automatic renewal: The subscription renews every year at the then current price, unless you cancel it before the end of the current period. With card payment, the amount is charged to the card automatically. With bank transfer, you receive an e-mail with the payment details and a 14-day deadline before the renewal. We will inform you of any price change before the renewal. Changing plan: You can move to a bigger plan at any time. The new plan applies immediately, and you only pay the price difference until the renewal date (by card immediately, by bank transfer within 14 days). A move to a smaller plan takes effect from the next renewal date; until then you keep your current plan, and no difference is refunded. Cancellation: You can cancel the subscription at any time on the Plans page or by writing to info@croaholiday.com. Cancelling stops future renewals; the plan remains active until the end of the period already paid for, after which you move to the free Basic plan. Until then, you can undo the cancellation, or a scheduled move to a smaller plan, on the Plans page. No refund is given for the unused part of the period, unless mandatory regulations provide otherwise. Failed or missing payment: If a card payment fails, Stripe retries it over the following days, and we inform you by e-mail. If no attempt succeeds, or if a bank transfer does not arrive even after the deadline, the subscription ends and the account moves to the free Basic plan. Moving to a smaller plan or to Basic: If you have more properties or units than the new plan allows, the oldest properties and units stay published up to the allowed number, and the others are hidden from guests. Nothing is deleted; you can publish the hidden content again when you choose a suitable plan. Right of withdrawal (consumers): In accordance with the Consumer Protection Act and Directive 2011/83/EU, a consumer generally has the right to withdraw from a distance contract within 14 days without giving any reason. Since this is a digital service that begins immediately at the user's request, the user expressly agrees, when purchasing, to the immediate start of the service and acknowledges that they lose the right of withdrawal once the service has been fully provided. If the user exercises the right of withdrawal while the service has been partially provided, they must pay a proportionate amount for the service provided up to that point.

6. Guest reviews

Reviews posted on the Platform come from real guests who have contacted a host through the Platform. Reviews are collected via a unique link (token) that the guest receives to leave a review, which ensures authenticity and makes it difficult to leave fake reviews. CroaHoliday does not publish fake reviews or reviews for which a fee has been received. The Platform reserves the right to moderate reviews to remove offensive, illegal, or inappropriate content, but it does not change the rating or the content written by the guest. In accordance with Directive (EU) 2019/2161 (the so-called Omnibus Directive), we state that we take reasonable and proportionate steps to verify that reviews come from users who have actually stayed at or used the accommodation in question.

7. Limitation of Liability

CroaHoliday is not responsible for: the accuracy of content posted by users; the fulfillment of obligations between the host and the guest; the quality of accommodation services provided; the content of communications outside the Platform; interruptions in the operation of the Platform due to technical difficulties or force majeure. CroaHoliday's total liability to the user shall not exceed the amount the user has paid for the use of the Platform in the past 12 months. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by applicable law.

8. Content and Posts

The user is fully responsible for the content they publish. It is prohibited to publish inaccurate, misleading, or offensive content, content that violates the rights of third parties, content that promotes discrimination or hatred, and content that violates applicable regulations. CroaHoliday reserves the right to moderate and remove content without prior notice.

9. Account Suspension

CroaHoliday may temporarily or permanently suspend a user account in the event of a violation of these Terms, fraudulent activity, false representation, posting of prohibited content, or at the request of the competent authorities. The user can request account deletion by sending an email to info@croaholiday.com. The deletion will be processed within 30 days.

14. Changes to the Terms

If the user is a consumer, the mandatory consumer protection provisions of the country of their habitual residence shall also apply, taking precedence over the provisions of these Terms to the extent that they are more favorable to the consumer. The aforementioned court jurisdiction does not affect the consumer's rights under Regulation (EU) No 1215/2012: the consumer may bring an action before the court of their habitual residence or the trader's place of establishment, and an action may be brought against the consumer exclusively before the court of their habitual residence.

16. Contact

17. Affiliate program

CroaHoliday offers an affiliate program through which individuals and legal entities (hereinafter: "Partner") can earn a reward for referring new hosts to the Platform. Reward Conditions: The Partner is eligible for a reward of €1 when a user registered through the partner's link lists an active accommodation with at least one unit. The Partner earns a commission of 30% of the first annual subscription (Pro, Premium, or Elite plan) paid by a host referred through the partner's link. The commission applies only to the initial payment—renewals do not generate a commission. Payment: Rewards are paid exclusively manually, upon the Partner's request, via an agreed-upon payment method (PayPal, bank transfer, or another agreed-upon method). All rewards are subject to a 14-day hold from the time of the subscription payment to protect against potential chargebacks. Rewards for activated hosts (€1) are available immediately upon confirmation of activation. CroaHoliday does not guarantee the payment of rewards in cases of suspected fraud, violation of these Terms, or abuse of the affiliate system. Tax Obligations: The Partner is solely responsible for reporting and paying taxes on income earned through the affiliate program, in accordance with the tax regulations of their country of residence. CroaHoliday assumes no responsibility for the Partner's tax obligations. Program Modifications and Termination: CroaHoliday reserves the right to modify the affiliate program terms or terminate the program at any time, with notice to Partners via email or a posting on the Platform. Rewards earned up to the time of the modification will remain valid. Participation in the affiliate program constitutes acceptance of these terms.

18. Business partners (advertising)

CroaHoliday publishes a list of local companies that provide services to hosts on the /partners page (cleaning, maintenance, photography, and the like; hereinafter: "Business Partners"). This section applies exclusively to these companies and is separate from the Affiliate Program in section 17. Paid Advertising: The listing on the /partners page and a featured spot in the host's user interface (dashboard) are paid advertising services. Business Partners pay an annual fee for the listing. The number of featured spots in the Host's user interface is limited, and CroaHoliday determines their number, placement, and appearance, as well as the regions in which each Business Partner is displayed. Paid placements are marked in a way that clearly informs the user that it is a paid promotion (for example, with a "Sponsored" or "Featured Partner" label). Duration and Renewal: The listing is valid for 12 months from the date of activation. The listing does not automatically renew and will not be charged for without an explicit new payment from the Business Partner. After expiration, the Business Partner can renew the listing by paying a new annual fee at the then-current rate. CroaHoliday reserves the right to change the price list for future periods. A price change does not affect the already paid posting period. CroaHoliday will make an effort to notify the Business Partner before the posting expires, but assumes no liability for a missed notification. Without an obligation to verify and without a recommendation: CroaHoliday is not obligated to verify the licenses, insurance, qualifications, or quality of work of Business Partners. A listing on the Platform is not a recommendation, a quality assurance, or a certificate of good standing. Content Liability: Information about services, prices, and areas of operation is provided by the Business Partners themselves and they are responsible for its accuracy. The Business Partner is responsible for the legality of all submitted texts, photos, logos, and other materials and guarantees that they have the right to use them and to grant CroaHoliday the right to publish them on the Platform. Host Relationship: Business Partners are independent companies and are not employees, agents, or subcontractors of CroaHoliday. Any arrangement, agreement, and payment are made directly between the host and the Business Partner. CroaHoliday is not a party to this relationship and does not charge a commission on the services of Business Partners. Limitation of Liability: CroaHoliday is not responsible for the quality of the services performed, adherence to deadlines, damages, omissions, or any disputes arising from the relationship between the host and the Business Partner. Guests resolve service complaints directly with the Business Partner. No Results Guarantee: CroaHoliday does not guarantee the Business Partner a specific number of inquiries, clicks, contacts, or completed transactions. The fee is for the publication and display, not for the results. Click Measurement: CroaHoliday counts clicks on Business Partner contact buttons for statistical purposes. Only the partner identifier, click type, and click time are recorded — no personal data, IP addresses, or cookies. Removal from the Platform: CroaHoliday may remove a Business Partner from the Platform in the event of a serious or repeated violation of these Terms, providing inaccurate or misleading information, or justified complaints from hosts. In the event of removal due to a violation by the Business Partner, the paid fee is non-refundable. If CroaHoliday removes a listing without cause on the part of the Business Partner, a pro-rated portion of the fee for the unused period will be refunded.
